Learned counsel for the petitioners is permitted to implead the District Magistrate, Azamgarh and Special Land Acquisition Officer, Azamgarh as respondents no.4 and 5.
Heard learned counsel for the petitioners and learned Standing Counsel for the respondents.
The petitioners claim to be the recorded owners of Plot No.775 total area 0.27 situate in Kalyanpur, Bankat, District Azamgarh. According to them land was acquired by the respondents for the construction of approach road in the year 2007 but till date the petitioners have not been paid any compensation.
Learned counsel for the petitioners contended that the direction be issued to the respondents to pay the petitioners the amount of compensation to which they are entitled to be paid.
Per contra learned Standing Counsel submitted that the petitioners have approached this Court directly without raising their grievance before the concerned authority. He next contended that the authority competent to consider and adjudicate upon the petitioners claim is the respondent no.3.
Having heard learned counsel for the parties, without expressing any opinion on merits, we dispose of this petition with the liberty to the petitioners to file fresh comprehensive representation along-with certified copy of this order before the respondent no.4/District Magistrate, Azamgarh, within a period of four weeks from today. In case any such representation is filed by the petitioners within the time so allowed, the respondent no.4 will consider and decide the same in accordance with law by a speaking and reasoned order, as expeditiously as possible, preferably within a period of two month from the date of filing of such representation before him by the petitioners. It is further directed that the respondent no.3 shall pay the compensation to which the petitioners are found entitled to receive within a period of one month from the date on which the petitioners representation is decided by the respondent no.4.
