The petitioner has filed this application for extension of time for a period of three months to deposit the first instalment.
The writ petition was filed against the recovery proceeding which was disposed of by order dated 19.1.2018 directing the petitioner to deposit the entire outstanding dues within four equal six monthly instalments. The first instalment was required to be deposited upto 12.3.2018. Now this application has been filed for extending the time for depositing the first instalment on the ground that locality of the petitioner was affected by hail storm due to which crops of the petitioner have been destroyed and he could not deposit the amount of of first instament within the stipulated period fixed by the Court.
In the fact of the case, the application is allowed. It is provided that the petitioner may deposit the first instalment upto 12th May, 2018 and in case the first instalment is deposited by 12th May, 2018 the bank shall accept it without objection.
