JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE C.V. NAGARJUNA REDDY WRIT PETITION No.35008 of 2014 Dated: 19.11.2014 Between:
M/s. Ramya Hospitals Private Limited, Rep. by its Managing Partner Pitani Annavaram .. Petitioner and The Andhra Pradesh Industrial Infrastructure Corporation Ltd. Rep. by its Chief Executive Officer/Executive Director/ Managing Director and others.

ORDER:
This writ petition is filed for the following substantive relief: “…to issue a Writ or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 1 & 2 in not considering the request and representations of the petitioner for grant of time to pay the amount towards the plot No.14C measuring Ac.0.214 cents (866.05 Sq.Mtrs) allotted in Health City, Chinagadili Village, Visakhapatnam Rural Mandal, Visakhapatnam District, for setting of Multi Speciality Hospital and further declaring the action of the respondents in trying to allot the above said plot in favour of the 3rd respondent herein as illegal, improper, arbitrary and unconstitutional and also against the principles of natural justice and consequently direct the respondents 1 and 2 to receive the amount from the petitioner for registration of plot No.14C measuring Ac.0.214 cents (866.05 Sq.Mts) allotted in Health City, Chinagadili Village, Visakhapatnam Rural Mandal, Visakhapatnam District, for setting of Multi Specialty Hospital by duly issuing the final allotment order forthwith.”
After arguing the case, Mr. Md. Saleem, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition with liberty to his client to challenge the cancellation order dated 20.02.2013.
The writ petition is accordingly dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to the dismissal of the writ petition, W.P.M.P.No.43798 of 2014 shall stand disposed of as infructuous.
