The writ petition arises out of a suit under Section 116 of U.P. Revenue Code, 2006 and it is directed against the final decree in the said suit and also appellate order whereby the Commissioner has dismissed the consequential appeal.
Against the order impugned petitioners have a statutory alternative remedy to file second appeal before the Board of Revenue as provided under Section 208 of U.P. Revenue Code, 2006, which has not been availed.
Under the circumstances, this writ petition is dismissed on the ground of availability of a statutory alternative remedy.
