Heard learned counsel for the defendants-petitioners.
In view of the order, which is proposed to be passed today, notices need not go to the private respondents.
The applicants have approached this Court for issuing direction to the Civil Judge (Junior Division), Basti to decide the interim injunction application (6-C2) filed in Civil Suit No.400 of 2017 (Vijaynath vs. Ramvriksha) within stipulated time.
Learned counsel for the petitioners states that the plaintiff- respondents filed the aforesaid Civil Suit No.400 of 2017 for permanent injunction against the defendants-petitioners alongwith an interim injunction application under Order 39 Rule 1 of C.P.C. read with Section 151 of C.P.C. and learned trial court had accorded an ex-parte interim injunction on 12.5.2017. The petitioners have filed their objection against the application (6C) on 27.7.2017 but till today the same has not been decided.
Considering the above, this petition stands disposed of with the direction upon the Court concerned to consider and decide the interim injunction application (6-C2) filed in Civil Suit No.400 of 2017 (Vijaynath vs. Ramvriksha) in accordance with law after giving opportunity of hearing to the plaintiff-respondent, as expeditiously as possible and preferably within four months from the date of production of certified copy of this order.
