JUDGMENT / ORDER

Heard learned counsel for the petitioner, Sri Amrish Sahai, learned counsel for respondent no.3 and learned Standing counsel. Petitioner had taken a loan for agricultural purpose. On account of non repayment of the same, impugned recovery dated 31.5.2010 has been issued against him.
The submission of the learned counsel for the petitioner is that the aforesaid loan has been waived by the authorities under the 'Wrin Mafi Yojna, 2008' but even then the recovery is being pressed. As to whether the petitioner's loan has been waived or not is a matter of fact which can not be examined in exercise of writ jurisdiction.
In this view of the matter writ petition is disposed of with liberty to the petitioner to make appropriate representation in this regard before respondent no. 3 within a period of two weeks' from today. In case such an application/ representation is made, the same shall be decided by the respondent no. 3 on verification of the record in accordance with law as expeditiously as possible preferably within a period of one month thereafter.
It is further provided that in the event the petitioner deposits a sum of Rs. 30,000/- and furnishes proof of such deposits along with his representation before respondent no. 3, the realization of the balance amount shall remain stayed after a period of two months from today or till the disposal of the representation of the petitioner whichever is earlier.
