The sole relief claimed in the instant petition is for issuance of a direction to the trial court to decide application filed by the petitioner under Order 9 Rule 13 CPC for setting aside exparte judgement and decree dated 3.10.2011, whereby civil death of the petitioner has been declared, expeditiously within a stipulated time.
Having regard to the peculiar facts of the instant case, the trial court is hereby directed to decide the application under Order 9 Rule 13 CPC most expeditiously and preferably within a period of three months from the date of production of a certified copy of this order, provided there is no legal impediment.
The petition stands disposed of accordingly.
