Petitioner met with an accident while travelling on his motor cycle on 15.11.2017 and sustained serious injuries. An application for grant of leave was moved and the petitioner subsequently joined his services. Grievance of the petitioner is that though his leave stands sanctioned but consequential benefits, as admissible in law, have been denied to him so far.
Attention of the Court has been invited to an order of the District Basic Education Officer, Farrukhabad dated 20.4.2018, whereby petitioner's medical leave for a period of 123 days has been sanctioned along with salary. Submission is that despite such order, amount of salary for such period, despite the order, has not been released.
Learned Standing Counsel submits that the grievance of the petitioner shall be examined by the authority concerned, in accordance with law.
In the facts and circumstances, noticed above, writ petition stands disposed of with a direction upon the respondent no. 2 to ensure that the petitioner's claim for release of salary for period medical leave is said to have been sanctioned to him, is examined forthwith, and benefit admissible thereunder shall be released within a period of 2 months from the date of presentation of certified copy of this order.
