Heard learned counsel for the applicant.
The writ Court vide order dated 29 August 2018 directed that in case any application for mutation is moved before the appropriate authority, in accordance with Section 33 of the Code, the same shall be considered by the authority concerned in accordance with law.
The order of the writ Court came to be served upon the competent authority as is reflected from the entry made in the revenue record (page 37 of the affidavit), however, on 10 December 2018 on the order of the Tehsildar, the authorities have directed that the entry in the revenue record does not relate to the khata no. 1.
In view thereof, no willful and deliberate disobedience of the writ Court order is made out.
The petition is, accordingly, dismissed with liberty to the applicant to assail the entries before the appropriate forum in accordance with law.
