For petitioner : Mr.M.Velmurugan For respondents : Mr.E.Raja, Addl.Public Prosecutor ORDER Petitioner has come forward with this petition seeking direction to the second respondent to file final report in Crime No.6/2016 before the Chief Judicial Magistrate, Cuddalore, which is pending on the file of the second respondent.
2. According to the petitioner, First Information Report was lodged on 14.10.2016 and the matter is pending without filing final report. He further states that some anti-social elements are threatening him to withdraw the case.
3. The learned Additional Public Prosecutor, submits that they are in the final stage of filing final report and sanction from the appropriate authorities is awaited.
4. Taking note of the above submission made by the learned counsel for the petitioner and the learned Additional Public Prosecutor, this court is of the view that it will be sufficient to grant the second respondent five months time to file the final report. Accordingly, the second respondent is directed to complete the investigation in Crime No.6 of 2016, and file final report before the Chief Judicial Magistrate, Cuddalore, as expeditiously as possible, preferably within a period of five months from the date of receipt of a copy of this order.
This Criminal Original Petition is disposed of accordingly.
