Notice on behalf of opposite party Nos.1, 2 and 3 has been accepted by the learned Chief Standing Counsel. Sri Pankaj Gupta, Advocate has accepted notice for opposite party No.22.
For the order proposed to be passed in this writ petition, issuance of notice to private respondent Nos.4 to 21 is dispensed with.
The writ petition has been filed challenging the impugned order dated 16.9.2020 passed by the opposite party No.3/Sub-Divisional Magistrate, Tehsil Mahsi, District Bahraich, as contained in Annexure - 1 to the writ petition, whereby the patta granted for fisheries rights, vide order dated 29.7.2019, at Gata No. 50M measuring area 1.897 hectare has been cancelled. The petitioner has statutory alternative remedy of appeal under Rule 59 of the U.P. Revenue Code Rules, 2016 which he has not availed. It appears that the petitioner has filed a revision which has been dismissed vide order dated 16.12.2020.
In view of above, we are of the view that there is no reason for us to grant indulgence at this stage.
The writ petition is accordingly dismissed with liberty to the petitioner to avail statutory remedy of filing an appeal against the impugned order dated 16.9.2020 passed by the opposite party No.3/Sub-Divisional Magistrate, Tehsil Mahsi, District Bahraich.
