1. The applicant has taken out present application seeking below mentioned relief:
"6(B) Your Lordships may be pleased to fix the early date of hearing of main Special Civil Application No.3665/2010 in the interest of justice, and thereby further be pleased to hear and dispose the main Special Civil Application No.3665 of 2010 on merits."
2. On perusal of the order dated 5th April 2010 passed in Special Civil Application No.3665 of 2010, it is noticed that the Court (Coram: Hon'ble Mr. Justice K.S.Jhaveri) has already directed "Rule. Expedited."
3. It is necessary to take into account the fact that the petition has been filed in 2010 and came to be admitted in April 2010. There are other senior/old matters which are pending on the cause list of final hearing. Under the circumstances it does not appear appropriate, at this stage, to grant out of turn hearing by allowing the request made by the applicant.
4. However, considering the facts and circumstances and the above mentioned order dated 5th April 2010, the office is directed to list the petition in the cause list for final hearing in due course and according to its seniority.
5. With the aforesaid clarifications and directions, the application is disposed of.
