This Court vide order dated 31-3-2009 has passed following final order in Civil Application No.7784 of 2007 in First Appeal No.58 of 1987:
In view of above observation and direction present application is disposed of. Registry of this Court is directed to sent papers of civil application no. 7784/2007 with all annexures with order passed by this Court to City Civil Court, Ahmedabad. After decision on this issue, City Civil Court is directed to sent papers of present civil application along with all annexures finding and decision which is to be given by City Civil Court, Ahmedabad.
It appears that till date, the aforesaid order passed by the Court is not complied with by the Registry though it is hard fact that First Appeal is of the year 1987. This is a very serious thing and hence, the office note put by the Registry is not acceptable.
In view of the above, the Registrar General is hereby directed to take appropriate action against the erring person for not complying with the order passed by the Court and place on record the report about the action taken.
It is pertinent to note that as the aforesaid order has not been complied with, this Court could not dispose of the First Appeal No.58 of 1987.
The Registry is directed to call for the quarterly periodical report about the progress of the case from the court below. The Registry is further directed to strictly comply with the aforesaid order dated 31-3-2009 passed by the Court in Civil Application No.7784 of 2007 in First Appeal No.58 of 1987 forthwith and on getting the decision on the issue from the court below shall place the matter before this Court.
