It appears that the Assistant Director of Education (Basic), Gorakhpur Region Gorakhpur had called for a report from the District Basic Education Officer, Deoria, on 29.6.2016, in the matter relating to grant of financial approval to the appointment of petitioners in Jai Jawan Jai Kishan Laghu Madhyamik Vidyalaya, Karahkol, District Deoria. According to petitioners, this letter has already been replied by the District Inspector of Schools, Deoria on 1.3.2017 and all details have been forwarded to the authority concerned, but the matter has remained pending eversince then. Hence, this petition.
Learned Standing Counsel submits that petitioner's grievance shall be examined, in accordance with law.
In the facts and circumstances, this writ petition stands disposed of with a direction upon the respondent no.2 to accord consideration to petitioner's claim, in accordance with law and keeping in view the report submitted by the District Inspector of Schools, Deoria dated 1.3.2017, within a period of three months from the date of presentation of certified copy of this order.
It is clarified that this Court has not examined petitioner's entitlement, on merits, and all issues are left open to be considered by the authority concerned, at the first instance.
