Heard learned counsel for the applicants, learned A.G.A.for the State and perused the record.
The applicants have invoked the jurisdiction of this Court under section 482 Cr.P.C. with a prayer to direct the court below to decide/expedite the Complaint Case no.1827 of 2013 (Old Case No.249 of 2010) (Stm. Mridul Tyagi vs. Ramshanker Tyagi & Ors.), under Section 12 of Domestic Violence Act, Police Station-New Agra, District-Agra, pending in the Court of Civil Judge, Junior Division,/Fast Track Court No.1, Agra within the stipulated period.
Learned counsel for the applicants has submitted that the aforesaid case pertains to the year 2010 and is pending before the court below and the proceedings of the aforesaid case are lingering on, on one pretext or the other. Learned counsel has further submitted that in order to secure the end of justice, the trial Court may be directed to expedite the trial within the time bound manner.
In view of the above, the court below is expected to make all endeavour to decide the aforesaid case expeditiously in accordance with law, after granting opportunity of hearing to both the parties and without giving unnecessary adjournments to the parties, if there is no other legal impediment.
With the aforesaid observations, the present application stands disposed of.
