The petitioner, has made an application to the respondent No.2, for attestation of the signatures of the Manager of the Institution. The elections, to the institution were held on 27.03.2017. However, the respondents-authorities, have not acted upon the election claim, set up by the petitioner. The petitioner claims to be the president of the committee of management.
The prayer, made by Sri Varad Nath, learned counsel for the petitioner, is that the representation of the petitioner, for attestation of the signatures, of the newly elected manager of the institution, may be decided within a stipulated period of time.
No useful purpose will be served by keeping the writ petition pending.
The matter is remitted to the respondent No.2- District Inspector of Schools, Mirzapur.
A writ of mandamus is issued, commanding the respondent No.2-District Inspector of Schools, Mirzapur, to decide the representation of the petitioner, for attestation of the signatures of the newly elected manager of the institution, preferably, within a period of one month, from the date of receipt of a certified copy of this order.
It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition, nor has judged the claim of the petitioner on merits. It is for the competent authority to verify the facts and return independent finding.
With the aforesaid direction, the writ petition is finally disposed off.
