Heard learned counsel for the applicant and learned A.G.A. for the State.
The present anticipatory bail application has been filed by the applicants- Ramsewak, Sanjeev Gupta and Himanshu in Case Crime No. 372 of 2018, under Sections 420, 467, 468, & 471 I.P.C., Police Station- Rauza, District- Shahjahanpur with the prayer to grant anticipatory bail to them.
I have perused the averments made in the first information report, the order by means of which the anticipatory bail application has been rejected by the court below as well as the material placed on record.
Learned counsel for the applicants has submitted that the applicants have been falsely implicated in the present case. Prima facie, no offence is made out against the applicants. The main allegations are against the son of applicant namely Sudhir Gupta. The applicants have no other reported criminal antecedents, therefore, the applicants may be enlarged on anticipatory bail.
Learned A.G.A. has opposed the prayer for anticipatory bail and submitted that after investigation charge-sheet has been submitted against the applicant on which cognizance has already been taken on 21.1.2019 and it appears that the applicants have not appeared before the Court till date.
In view of the fact that charge-sheet has been submitted, it would be appropriate that regular bail may be moved by the applicants before the courts below which shall be decided in accordance with law.
Accordingly, the application for anticipatory bail is rejected.
