Heard learned counsel for the petitioner and learned AGA for the State through Video Conferencing as well as perused the record.
By means of this petition, the petitioner seeks issuance of a writ, order or direction in the nature of certiorari quashing of the impugned order dated 06.03.2021 passed by opposite party No.3 in Case No.00392/2021 (State Vs. Ramsagar @ Sagar Yadav) under the provision of Section 3(1) U.P. Goondas Act, 1970.
Admittedly, the appeal under Section 6 of U.P. Control of Goondas Act, 1970 is pending before the competent authority which arose out of order passed on 06.03.2021.
The petitioner may be well advised to approach the appellate authority for the relief sought in this writ petition. Simultaneous proceedings before this Court while the pendency of appeal, may not be maintainable, however, the petitioner may approach the appellate authority for interim stay. In case, any such application is made, the same shall be decided expeditiously in accordance with law.
Accordingly, the writ petition is disposed of.
