JUDGMENT / ORDER

Heard learned counsel for the applicant and learned A.G.A. This application under Section 482 Cr.P.C has been filed by accused against the summoning order dated 11.05.2010 passed by the Chief Judicial Magistrate, Shravasti in Criminal Case No. 1543 of 2010 (Case Crime No. 40 of 2010), State Vs Inrajeet and others whereby the learned Chief Judicial Magistrate has summoned the accused for the offences under Sections 498-A IPC and ¾ D.P. Act.
At this stage, learned counsel for the applicants instead of pressing the application on merit request that the petition be finally disposed of with the observation that in case accused applicants appear before trial court and move any bail application the same be disposed of in the light of law laid down by the Apex Court in Lal Kamlendra Pratap Singh Vs. State of Uttar Pradesh and others, reported in (2009) 4 SCC 437 Learned A.G.A has no objection.
In view of the above submission of learned counsel for the applicants, the application is disposed of finally with the observation that if the applicants surrender before the trial court within thirty days from today and move an application for bail, the same shall be disposed of by the court below preferably on the same day keeping in view the law laid down by the Hon'ble Apex Court in the case of Lal Kamlendra Pratap Singh Vs. State of Uttar Pradesh and others, reported in (2009) 4 SCC 437. Till then, no coercive process will be adopted by the trial court. Order Date :- 21.6.2010 Amit
