List in next cause list along with Writ B No. 51273 of 2015 showing full particulars of parties and their counsels in both the writ petitions.
Counsel for the petitioner submits that after the order of Deputy Director of Consolidation dated 27.1.2012 Gurnam Singh, respondent-2 filed an application for recall of the aforesaid order. Subsequently, he filed Writ B No. 51273 of 2015. In paragraph 37 of the writ petition, Gurnam Singh has stated that he had filed a restoration application against the order of Deputy Director of Consolidation. In paragraph 38, it has also been stated that on 7.8.2015 he filed an application for dismissing the restoration application as not pressed. Similar facts has been repeated in paragraph 40 of the aforesaid writ petition. Thereafter he filed Writ B No. 51273 of 2015. When no interim order could be obtained in the aforesaid writ petition then he again filed an application for recall of the order dated 27.1.2012 before Deputy Director of Consolidation on 13.5.2016 on which the interim order directing the parties to maintain status quo, has been passed. Thus the restoration application has been filed concealing the material fact that earlier a restoration application has been filed which was got dismissed as not pressed and thereafter writ petition was filed. These facts were deliberately concealed by Gurnam Singh.
The matter requires consideration.
Till next date of listing, operation of the order dated 13.5.2016 passed by Deputy Director of Consolidation shall remain stayed.
