This writ petition has been filed seeking the following relief:-
"A. In the nature of Certiorari calling for record of the case Quashing the Impugned order dated 23.02.2021 passed by the respondent no.1 resuming old Gata no.309m (Mil Jumla) land new Gata no.158 situated in Village Biralasa, Pargana Charthawal, Tehsil Sadar, Muzaffarnagar and allotting it to respondent no.4 forthwith.
B. In the nature of mandamus commanding the respondents to proper correct/amend Map 1369F after measurement of petitioner's Gata no.153, 156 and 157 Village Biralasa, Pargana Charthawal, Tehsil Sadar, Muzaffarnagar.
C. In the nature of Mandamus commanding the respondents to consider petitioner's claim as per application dated 04.06.21, 14.06.21 and decide it within specified short period after hearing petitioner by reasoned order."
Learned counsel for the petitioner, after arguing some time, on instructions, submits that prayer nos.1 & 2 be considered as not pressed and prayer no.3, which is for expeditious disposal of the application pending before the Consolidation Officer filed under Section 9(A)(2) of the U.P. Consolidation of Holdings Act, 1953, be decided.
Learned Standing Counsel has no objection to the prayer made by the learned counsel for the petitioner.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to Consolidation Officer, Sadar-II, Muzaffar Nagar, to decide petitioner's aforesaid application expeditiously and pass appropriate reasoned order after affording opportunity of hearing to all concerned parties, if there is no other legal impediment.
