Heard learned counsel for the petitioner and learned Standing counsel.
The petitioner claims that she is in possession of land of gata no. 1738/2 situate in Village Adampur, Tehsil Hasanpur, District Amroha. The anti-social elements with the bhoo-mafia are interfering in her possession over the said land. Therefore, she has preferred this writ petition seeking direction for protection of her possession.
The dispute as raised by the petitioner in the writ petition appears to be a private dispute for which the proper remedy available to the petitioner is by way of civil suit. In case the land of the petitioner is being grabbed by bhoo-mafia, she may approach the district administration specially the District Magistrate by means of a representation in accordance with G.O. dated 1.5.2007. In case any such representation is filed, the District Magistrate shall consider it in the light of the aforesaid G.O. and if grabbing is by bhoo-mafia, take steps to protect the petitioner.
The writ petition is disposed of accordingly.
