Heard counsel for the petitioners as also counsel for the caveator.
Challenge to the order impugned of the writ petition is primarily on the ground that it has been passed ex-parte.
In my considered opinion, the question as to whether the order impugned is ex-parte or not is a pure question of fact and better addressed by the authority who has passed the impugned order.
The writ petition is therefore disposed of granting liberty to the petitioner to file an application for recall of the order on the ground that it is ex-parte, in case so advised.
