Heard the learned counsel for the applicant as well as the learned A.G.A. for the State and perused the record, Contention raised on behalf of the applicant has been confined to the extent that the applicant is innocent and has been falsely implicated in this case on several counts and that he has been falsely named in the FIR and no offence whatsoever has been committed. The FIR has been lodged after a delay of one day. The injury was caused on 10.12.2017 whereas the report was lodged on 11.12.2017 Nothing incriminating has been recovered from the possession of the applicant. The recovery is not supported by independent testimony.
The learned A.G.A. opposed the prayer for bail and submitted that in this case the applicant alone committed the offence on 10.11.2017. He is named in the FIR and recovery has been affected against him of two bangles. The injured has sustained the injury on several parts of her body. She is an old lady of 70- 75 years.
After hearing the submission raised by learned counsel for the applicant and the reply by the learned A.G.A. and upon perusal of the various documents annexed with the present bail application and also looking to the seriousness of the allegation made in the FIR and considering the merit,no good ground is made out for bail.
Accordingly, this bail application is rejected.
