The petitioner entered into a contract with the respondent Municipality for the construction and operation of a Municipal Solid Waste Treatment Plant (MSW Plant for short) at Vadavathoor in Vijayapuram Grama Panchayat in Kottayam District. The treatment plant was set up for the purpose of treating the solid wastes generated within the limits of the Municipality. However, the plant had to be closed down due to agitation by the local public against the plant. The petitioner alleges that though substantial amounts are due to them from the Municipality, despite repeated requests for payment, no payment has been made so far. Exts.P8, P9 and P10 are pending consideration of the respondent. The petitioner, therefore, seeks the issue of appropriate directions for the consideration of Exts.P8, P9 and P10 and for passing appropriate orders thereon. 2. 3. In view of the limited relief sought, it is sufficient that the writ petition is disposed of, directing Exts.P8, P9 and P10 to be considered by the respondent.
This writ petition is, therefore, disposed of directing the respondent to consider Exts.P8, P9 and P10 in accordance with law and to pass appropriate orders thereon, after affording an opportunity of being heard to the petitioner also, as expeditiously as possible, and at any rate, within a period of two months of the date of receipt of a copy of this judgment.
