JUDGMENT / ORDER

In Chamber
Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 6794 of 2021 Applicant :- Ramkishor Opposite Party :- State of U.P. and Another Counsel for Applicant :- Sunil Kumar Dwivedi Counsel for Opposite Party :- G.A.,Manoj Kumar Tiwari,Sunil Kumar,Vikram Shah Sisodia
Hon'ble Saumitra Dayal Singh,J.
1. Heard Sri Sunil Kumar Dwivedi, learned counsel for the applicant; Sri Manoj Kumar Tiwari, learned counsel for the informant and learned A.G.A. for the State through video conference.
2. This anticipatory bail application has been filed on behalf of the applicant - Ramkishor, seeking anticipatory bail in Case Crime No. 1472 of 2020, under Sections - 498-A, 323, 504, 506, 307 I.P.C. and Section 3/4 D.P.
Act, Police Station - Iglas, District - Bulandshahr, during pendency of trial.
3. While learned counsel for the applicant submits that the applicant has been falsely implicated arising from matrimonial dispute between the first informant and her husband, perusal of the FIR reveals specific role assigned to the applicant as well. Purely on account of such allegation, discretion claimed for grant of anticipatory bail is declined.
4. Accordingly, the present anticipatory bail application is rejected, leaving it open to the applicant to apply for regular bail, which application when filed may be dealt with and decided on its own merit, as expeditiously as possible, without being prejudiced by any observation made in this order.
