1. This petition has been preferred against the judgment and award dated 27.10.2010 passed by the Labour Court, Surendranagar in Reference (LCS) No.190/1995 whereby, the said reference was rejected.
2. The facts in brief are that the petitioner herein was serving as a Store Clerk with the respondent. He was dismissed from service in pursuance of the departmental inquiry wherein, he was found guilty of operating a milk depot in a dummy name. The Reference preferred against the same was rejected. Being aggrieved by the same, the present petition has been preferred.
3. Heard learned counsel for the petitioner and perused the documents on record. It appears from the record that the petitioner had been operating a milk depot in the name of one "D.C. Mandalia". The said person was a dummy person and the petitioner had been operating the depot in the name of the said dummy person. The petitioner had issued cheques and had also signed vouchers on behalf of the dummy person. In the inquiry proceedings, the allegations made against the petitioner were proved beyond doubt and therefore, the respondent dismissed the petitioner from service. Considering the evidence on record, I am of the opinion that the respondent was completely justified in passing the impugned order of dismissal. I am in complete agreement with the findings arrived at and the reasonings given by the Labour Court in the impugned award and hence, find no reasons to entertain this petition.
4. For the foregoing reasons, the petition is summarily rejected.
