1.0. Present Civil Application has been preferred by the applicants herein-original defendants for an interim relief during the pendency and final disposal of the Second Appeal i.e. to stay the further implementation, execution and operation of the judgment and order dated 21.6.2011 passed by the learned Principal District Judge, Gandhinagar passed in Regular Civil Appeal No. 21 of 2007.
2.0. Having heard Shri Sunit Shah, learned advocate for the applicants and Shri Jadeja, learned advocate for the respondents herein-original plaintiff, further implementation, execution and operation of the judgment and order dated 21.6.2011 passed by the learned Principal District Judge, Gandhinagar passed in Regular Civil Appeal No. 21 of 2007 is hereby stayed and earlier ad-interim relief is hereby made absolute with a further clarification that whatever was the interim relief operating in the appeal before the learned Appellate Court the same is also directed to be continued till final disposal of the main Second Appeal. Rule is made absolute to the aforesaid extent.
