Heard learned counsel for the parties.
The writ court had disposed of the writ petition vide order dated 30.03.2018, which reads thus:
"Heard learned counsel for the petitioners and learned Standing counsel for the State.
This writ petition has been filed by the petitioners for the following reliefs :
(a) issue a writ, order or direction in the nature of mandamus directing the respondents to clear the outstanding bills of the petitioners or pass reasoned and speaking order for not doing the same.
(b) issue any other writ, order or direction which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case.
(c) Award costs and counsel's fee of the petition to the petitioners.
From perusal of the material and averments made in the writ petition, it transpires that the petitioners for redressal of their grievance filed a representation before the respondent no. 2 Mission Director, National Health Mission (N.H.M.), U.P. on 20.12.2017 (Annexure-6 to the writ petition) but the same has not been decided till date. Hence, a direction be issued to respondent no. 2 to consider and decide the representation pending before him.
Having heard the learned counsel for the parties present and perused the averments made in the writ petition, without expressing any opinion on the merits of the case, we dispose of this writ petition with a direction to the respondent no. 2 Mission Director, National Health Mission (N.H.M.) U.P. to consider and decide the representation filed by the petitioners before him on 20.12.2017 (Annexure-6) by a speaking and reasoned order within a period of six weeks from the date of production of certified copy of this order before him."
It is contended by learned counsel for the applicant that the opposite party has not considered and decided the representation of the applicant.
On specific query, learned counsel for the applicant, ultimately, seeks execution of a contract entered by the applicant with the opposite party for supply of vehicles, for which the opposite party has not cleared the pending bills. The copy of the agreement has not been placed on record. In any case, the contempt court would not enter into the disputes which fall within the private domain of the parties.
The remedy available to the applicant is to approach the appropriate forum in accordance with law.
The contempt petition is, accordingly, dismissed.
