Heard learned counsel for the petitioner and learned Standing Counsel for the State.
By this petition, the petitioners have prayed for the following reliefs:-
"i. A writ order or direction in the nature of Certiorari for quashing the impugned order dated 14.10.2020 passed by respondent No.3 by which the respondent no.3 passed order for releasing the award in favour of respondent No.4.
ii. A writ order or direction in the nature of mandamus directing the respondent no.3 to consider and decide the application dated 21.12.2020 and reminder dated 15.06.2021 moved by petitioner, pending before respondent No.3.
iii. A writ order or direction in the nature of mandamus directing the respondent no.3 to provide compensation award whhich was acquired under U.P. Expressway Industrial Development Authority."
The order of Special Land Acquisition Officer-respondent no.3 is under challenge. The petitioner has already moved respondent no.3 as, according to him, he has right, title and interest in the compensation.
Sri M.C. Chaturvedi assisted by Sri S.C. Dwivedi, learned counsel appearing for the respondent no.2 and the learned Standing Counsel state that it is private dispute between the petitioner and the respondent no4.
Regard being had to the facts and submissions, it is observed that the respondent no.3 shall re-consider the case of the petitioner and decide the same expeditiously, preferably within a period of six weeks from today and if the order is against the petitioner, remedy would be available to him under civil jurisdiction.
With these observations, present petition is disposed of.
