Heard learned counsel for the petitioner, learned Standing Counsel for the respondent nos.1 to 3 and perused the record.
Present petition has been filed by the petitioner beseeching early disposal of Case No.225 T.B. (Ramjanam and others Vs.State) under Section 9A(2) of the U.P. Consolidation of Holdings Act, 1953 (in brevity "U.P.C.H.Act") pending before the Consolidation Officer, Sathiyaon, District-Azamgarh (respondent no.2).
It is submitted by learned counsel for the petitioner that in respect of plot in question i.e. plot no.90/1, area 0.356 hectares situated at Mauja-Harriya, Pargana-Mohammadabad, Tehsil- Sadar, District-Azamgarh, petitioner has moved application dated 11.12.2020 (Annexure-12) under Section 9A(2) of the UPCH Act, which is still pending for disposal. In the aforesaid matter opposite party has already put in appearance and the report has also been submitted by the Tehsil authorities in pursuance of the order passed by the Consolidation Officer.
Grievance of the petitioner is that after the report, matter is pending protracted and no fruitful step is being taken to decide the matter.
Learned Standing Counsel contended that he has no objection, if this Court issues any direction for final disposal of the aforesaid application, which is still pending.
In this conspectus as above, no useful purpose would be served by keeping this matter pending, therefore, this court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the writ petition, with a direction to the respondent no.2 to decide the application dated 11.12.2020 (Annexure-12) in accordance with law, expeditiously, preferably within a period of ten months from the date in receipt of a copy of this order.
The petitioner shall file a computer generated copy of this order downloaded from the official website of High Court, Allahabad, supported by an affidavit, which shall be verified by the concerned authority from the website of the High Court.
With the aforesaid observations, this petition is finally disposed of.
