Heard Mr.Qureshi, learned advocate for the applicant and Mr.YN Ravani, learned advocate for the respondent No.3 - C.B.I. It is submitted that the issue involved in this matter is connected with Writ Petition (Criminal) No.6 of 2007, which is pending before the Hon'ble Apex Court, and my attention was drawn to the copy of status report (pages 63 to 94).
In this view of the matter, it is requested that the further proceedings of Sessions Case No.437 of 2006, pending before the trial Court, may be stayed. However, it is submitted that before the trial Court, no application is filed, stating the above grounds for staying the proceedings. Mr.Qureshi, learned advocate for the petitioner submits that he shall file such application before the trial Court, stating all the relevant grounds for staying the further proceedings of the said sessions case.
Petitioner is permitted to move the trial Court by filing appropriate application and the trial Court shall decide such application in accordance with law at the earliest, irrespective of the pendency of Special Criminal Application No.2626 of 2010 in this Court. S.o to 22.2.2012.
