JUDGMENT / ORDER

Heard learned counsel for the applicant, learned A.G.A. and perused the F.I.R. and other relevant papers filed in support of the bail application.
Counter affidavit filed by the State, is taken on record.
The submission of learned counsel for the applicant is that co-accused Girdhari @ Ramakant has already been granted bail by this Court vide Crl. Misc. Case No.8522/2009 dated 22.1.2010. The applicant claims parity with co-accused Girdhari @ Ramakant on the ground of similar role assigned to both the accused persons, State counsel does not dipsute the same. Learned counsel submits that allegations levelled against the accused applicant are flimsy and not worthy of credence. The applicant is in jail since 26.11.2008, as averred in para 2 of the bail application and there is no criminal history as averred in para 15.
Considering the overall aspects of the matter and without entering into the merit of the case, I hereby provide that the applicant, Ramjan Ali @ Bablu be released on bail in Case Crime No.1221/2008, under Sections 395, 397, 364, 412 I.P.C., P.S. Mill Area, District Raibareily, on his filing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned/remand magistrate.
