The petitioners allege that the alignment of proposed Sohrakha Bishrakh Link Road connecting Noida to Greater Noida should not be changed. It is stated that earlier the proposal was to construct the aforesaid Link Road through the land of the petitioners for which talks did takes place but subsequently the alignment has been changed in such manner that the land of the petitioners is not needed now. The petitioners allege that change of alignment is not a wise decision and that an enquiry should be conducted as to why the alignment has been changed. For this reason petitioners have also placed reliance upon the directions issued by the Commissioner.
We are not inclined to entertain this petition. The land of the petitioners have not been acquired nor the Authorities are insisting that petitioners should execute a sale deed in favour of Noida.
The petitioners do not have any cause of action as their lands have not been acquired. In any case, it has been pointed out by Shri Kaushalendra Nath Singh, learned counsel appearing for Noida that the cost of construction has been reduced by change of the alignment.
The writ petition is, accordingly, dismissed.
