Heard learned counsel for the petitioner and Sri Sunil Kumar Singh, learned counsel appearing for the Gaon Sabha.
Present petition has been filed with following prayers:-
"i) Issue, a writ order or direction in the nature of certiorari quashing the order dated 30.9.2020 passed by the respondent no.3, Assistant Collector, Ist Class/ Tehsildar, Tehsil-Saidpur District- Ghazipur in Case No.- 429/2019/Computerised Case No. T 201914290400429 (Report Lekhpal vs. Ramharakh @ Ramharsh) U/S 67 of U.P. Revenue Code-2006.
ii) Issue, a writ order or direction in the nature of mandamus commanding the respondents not to take any coercive action against the petitioner in pursuance of order dated 30.9.2020 passed by the respondent no.3, Assistant Collector, Ist Class/Tehsildar, Tehsil- Saidpur District- Ghazipur."
At the very outset, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition so as enable him to avail the statutory remedy of the appeal.
Accordingly, present petition stands dismissed as withdrawn.
In case, certified copy is required, office is directed to supply the same after obtaining photocopies of the same within a period of one week.
