Learned counsel for the appellants and learned A.G.A. for the State are present.
It is reported that all the three appellants have been died. Regarding this, the report of the Chief Judicial Magistrate, Meerut dated 13.10.2021 is on record. He has appended with his report, the letter of S.I. Suryadeep Singh, police station Pallavpuram District Meerut that appellants Rameshwar, Gyan Chandra and Anand Prakash have died. Dharmendra Gautam, the nephew of the deceased Rameshwar, has stated in his statement that appellant Rameshwar has died on 26.8.2019. Harishchandra, the brother of appellant Gyan Chandra, has stated in his statement that Gyanchandra has died on 27.8.2014. Lakhan Singh, the son-in-law of the deceased Anand Pal and Azadbir, the brother-in-law of deceased Anand Pal have stated that Anand Pal has died on 24.6.2010. The death certificates of all the three appellants are also appended with the report.
Thus, as per the statements of all the witnesses, appended to the report of the Chief Judicial Magistrate, Meerut, that all the appellants Rameshwar, Gyan Chandra and Anand Prakash have died, so the appeal against all the appellants stands dismissed as abated.
