Learned Standing Counsel has filed a personal affidavit of Dilip Kumar, the District Supply Officer, Prayagraj today which is taken on record.
In the personal affidavit, it has been stated that the respondent No.2, Commissioner (Food and Civil Supplies), U.P., Jawahar Bhawan, Lucknow has passed an office order giving sanction for payment of Rs. 2,13,695/ to the petitioner. In furtherance of that order, the District Supply Officer, immediately sent a letter dated 24.9.2019 to the Senior Treasury Officer, Indira Bhawan, Civil Lines, Allahabad regarding payment of that amount to the petitioner and the required Token number was generated by the Drawing and Disbursing Officer, Regional Account Officer (Food), Prayagraj Region, Prayagraj. Photo copies of letter dated 24.9.2019 of respondent no.4 and a copy of Token No. 641959810 generated by the Drawing and Disbursing Officer have been enclosed as Annexure No. A-2 to the affidavit.
Learned counsel for the petitioner states that the amount has been received by the petitioner.
In view of the aforesaid payment being made, this writ petition, accordingly, does not survive and is, therefore, dismissed.
