Heard learned counsel for the petitioners. Sri S.C. Dwivedi, learned counsel has appeared on behalf of respondent No.2.
The petitioners by means of this writ petition want a direction upon respondent No.1 and the District Collector, Etawah to make payment of compensation of their land at the higher circle rate as enhanced vide order dated 03.09.2014.
It is apparent that the petitioners have transferred their land by registered sale deeds executed on 01.09.2014, 02.09.2014, 04.03.2014 and 04.09.2014 in favour of the respondents.
All the aforesaid sale deeds except one are of the dates prior to 03.09.2014 when the rate was enhanced and as such the enhanced rate is not applicable to those sale deeds.
Even otherwise, the petitioners have sold their land with open eyes at the sale consideration mentioned therein which have been paid to them and as such they cannot complain of low payment and demand any higher sale consideration. The execution and registration of sale deeds give rise to concluded contracts and its terms and conditions cannot be alterted subsequently.
In case the petitioners feel that they have been duped by the respondents and have been paid inadequate sale consideration, the remedy if any, available to the petitioner is by way of civil suit or as may be advised to them in law.
