Petitioners have approached this Court challenging an order dated 1.7.2013, rejecting petitioners' claim for grant of benefit of second promotional pay scale and the representation made in that regard has also been rejected. A mandamus has been prayed to be issued to respondents to provide second promotional pay scale upon completion of 24 years of service and extend pay scale according to ACP scheme alongwith all other consequential benefits.
Learned counsel for the petitioner during the course of submission has placed before the Court a subsequent recommendation sent by the District Magistrate, Bulandshahr dated 22.5.2018 to the Principal Secretary, Department of Revenue, Govt. of U.P., Lucknow. The recommendation dated 22.5.2018 is taken on record. Grievance is stated that though the matter has been forwarded to the State Government and that petitioners' name finds mentioned in it, but a final decision is yet to be taken by the State.
Learned Standing Counsel submits that appropriate decision would be taken by the authority concerned.
In such circumstances, ends of justice would be met in disposing of the writ petition requiring the respondent no.1 to take an appropriate decision upon the recommendation sent by the District Magistrate, Bulandshahr dated 22.5.2018, in accordance with law, with regard to grant of various service benefits, within a period of three months from the date of presentation of certified copy of this order.
Subject to the aforesaid observations, this writ petition stands disposed of.
