Heard Mr. Zubin Bharda, learned Advocate for the petitioners and Mr. Kaushal Pandya, learned Advocate, who appeared on advance copy, at the request of the Court. Mr. Bharda states that during the pendency of the present petition, one of the petitioners has expired. Mr. Bharda states that as such the cause does not survive as the impugned notice which has been challenged is implemented. However, it is made clear that it would not prejudice the rights of the petitioners to get compensation as envisaged under the Provisions of the Bombay Provincial Municipal Corporations Act, 1949. With this observation, the petition does not survive and the same is disposed of.
