JUDGMENT / ORDER

1. Heard Mr. Prabhakar Upadhyay, learned Counsel for the petitioner. Mr. Upadhyay has submitted that in fact, as per the statement furnished by the respondent Bank the petitioner has already deposited the amount of Rs.54,000/- and odd on 11.2.2006. The statement which is annexed to the petition shows that the total dues payable as on 11.5.2007 comes to Rs.50,981/-, which includes interest segment for the period from 26.6.2006 to 11.5.2007, which comes to Rs.5,779/- on condition that the petitioner deposits the amount of Rs.16,000/- with Board of Nominees, Ahmedabad. Notice returnable on 13.3.2012.
2. It would be open for the petitioner to apply for adjournment in the Execution Petition which is pending before the learned Small Causes Court, Ahmedabad and the said Court shall consider the same in accordance with law. Direct service permitted.
