The matter was referred for mediation and has been settled. The memorandum of settlement has been produced by the learned Mediator. We have perused the same. The appeal is disposed of as settled and the terms and conditions of the agreement will form part of the judgment and decree.

The court fee paid on the memorandum of appeal will be refunded to the appellant. The parties will bear their costs in the appeal.
