In Re:Review Application No.2 of 2018 This application is preferred to have review of the judgment dated 23rd August, 2018 passed by us in this appeal.
By the judgment aforesaid, the special appeal giving challenge to the judgment passed by learned single Bench was affirmed in result the order dated 25th January, 2012 passed by the District Inspector of Schools, Saharanpur also came to be confirmed.
It is submitted by learned counsel appearing on behalf of the appellant review petitioner that this Court has not taken into consideration and has also not decided the issue with regard to violation of certain provisions relating to submission of acceptance and resignation of an Assistant Teacher.
On going through the judgment passed by learned single Bench and the writ petition, we do not find that any such argument was ever raised by the review-petitioner. The judgment of Division Bench is confined to the issue that was decided by learned single Bench.
In addition to that, the appeal was also dismissed on the count of conduct of the review petitioner. No eventuality as such exists in the instant matter that may warrant interference by invoking our powers to review a judgment passed.
The review application is dismissed.
