Heard Sri Anil Kumar Dubey, learned counsel for the applicant, Sri I.P.Srivastava, learned A.G.A. for the State and perused the record.
It has been argued by learned counsel for the applicant that though the prosecutrix is stated to be minor girl and there is allegation of rape against the applicant under Section 164 Cr.P.C. but the same is not corroborated with the medical report. The applicant is in jail since 26.10.2015.
Learned AGA opposed the prayer for bail and submitted that the victim is minor. As per F.I.R., she is aged about 15 years and according to medical report, she is aged about 16-17 years. The trial is in progress.
Without expressing any opinion on the merits of the case and considering the submissions advanced, I find that no good ground is made out for enlarging the applicant on bail.
The bail application of the applicant Ramesh, involved in case crime no. 1039/2015, under Sections 363, 366, 368, 376, 328, 372, 373 IPC & 3/4 POCSO Act, P.S. Nyuria, District Pilibhit is, accordingly, rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within a period of six months from the date of production of certified copy of this order before the trial court.
The applicant is directed to produce the certified copy of this order before the trial court for it's compliance.
