Heard Sri Satyendra Narayan Singh, learned counsel for the applicants and learned AGA for the State.
The present 482 Cr.P.C. application has been filed to quash the order dated 09.08.2019 as well as the entire proceedings of Case No. 198/2018 (Smt. Majeet Kaur @ Vandana Vs. Rajnish @ Kavi And Others), under Section- 23 of Domestic Violence Act, District- Saharanpur, pending in the court of A.C.J.M., IV, Saharanpur.
It reflects from the record that applicants were directed to provide a residence of one room along with toilet and bathroom to the opposite party and restrain them from creating any violence against her.
The impugned order passed under Section 23 of the Act, is an appeal-able order under Section 29 of the Act. The applicants have a remedy to file appeal before the appellate court.
The present 482 Cr.P.C. application is dismissed on the ground of alternative remedy available to the applicants under Section 29 of the Act.
Office is directed to return the certified copy of the impugned orders, after retaining the photocopy of the same on record.
