Court No. - 59
Case :- CONTEMPT APPLICATION (CIVIL) No. - 1067 of 2018 Applicant :- Ramesh And Another Opposite Party :- Asha Ram Yadav Sub Divisional Magistrate Counsel for Applicant :- Nilam Pandey
Hon'ble Yashwant Varma,J.
Heard learned counsel for the applicants.
A petition was disposed of by the High Court on 4 May 2017 directing the Sub Divisional Magistrate to conclude proceedings in respect of a case instituted under the U.P. Land Revenue Act, 1901 expeditiously and preferably within a period of six months. A perusal of the order sheet reveals that on more than 13 occasions, the matter has not been taken up for disposal on account of the lawyers abstaining from work.
In view thereof, this Court finds itself unable to hold that the opposite party is in contempt. While the petition is dismissed, it is only observed that the competent authority shall endeavour to dispose of the pending proceedings with expedition and without granting any unnecessary adjournments.
