Heard Sri S.M. Nazir Abbas Abedi, learned counsel for the applicant, Sri Sikandar B. Kochar, learned counsel for the complainant and Sri I.P. Srivastava, learned A.G.A. for the State.
The first two bail applications of the applicant were rejected by this Court vide orders dated 2.12.2014 and 22.4.2016, hence this third bail application has been moved on behalf of the applicant.
The new ground which has been argued by the learned counsel for the applicant is that while rejecting the second bail application of the applicant this Court directed the trial court to expedite the trial of the present case within a period of eight months from the said date though the trial of the applicant has been separated from other co-accused persons, who were absconding but the same has not been concluded as yet, hence the applicant, who is in jail since 13.4.2014 be released on bail.
Learned counsel for the complainant and learned A.G.A. vehemently opposed the prayer for bail and have submitted that only on account of delaying tactics adopted by the applicant the trial of the present case could not proceed.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Ramesh Tiwari involved in Case Crime No. 258 of 2014 under sections 363, 364-A, 302, 201 I.P.C., police station George Town, District Allahabad.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same on day to day basis within a further period of six months from the date of production of a certified copy of this order.
