Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicant with the prayer to direct the Trial Court to provide the relevant document of the applicant in S.S.T. No. 6 of 2014 (State Vs. Raj Kumar and others), arising out of Case Crime No. 170 of 2013, under Sections 304/34 IPC, Police Station Baberu, District Banda.
Learned counsel for the applicant has submitted that the applicant was summoned on the basis of an application under Section 319 CrPC. Pursuant to said summoning order, he appeared before the trial court on 23.03.2018 and thereafter, he has been released on bail.
Again on 08.05.2018, the applicant appeared before the trial court and in compliance of provision under Section 207 CrPC, the copies have been served upon him of the police report and documents, which is evident from the order dated 08.05.2018 passed by Additional Sessions Judge Ist/ Fast Track Court, Banda. Even on the order-sheet, there is specific endorsement that the copies have been received by the applicant Ramesh, however, present application has been filed to direct the trial court to provide copies of the police report and documents to the applicant.
From the perusal of the order dated 08.05.2018 passed by the trial court, it is clearly evident that the copies have already been served upon the applicant. The application filed by the applicant for making him available copies under Section 207 IPC is wholly misconceived.
In view of the order dated 08.05.2018 passed by the trial court, present application under Section 482 CrPC is wholly misconceived and it is accordingly dismissed.
