Heard learned counsel for the petitioner and learned A.G.A. for the State.
This writ petition has been filed with the prayer to issue a writ, order or direction in the nature of certiorari quashing the impugned F. I. R. which has been registered as Case Crime No. 53 of 2016 u/s 376-D, 342, 420, 467, 468, 471, IPC and 3/4 Prevention of Children from Sexual Offences Act, Police Station Bahariya, District Allahabad.
After hearing learned counsel for the parties and after perusing the averments made in the present writ petition, no case for any interference has been made out. Accordingly, the prayer, as made above, is refused.
However, without expressing any opinion on the merits of the case, it is directed that in case the petitioner appears and surrenders before the courts below and applies for bail, his prayer for bail shall be considered and decided expeditiously.
With the aforesaid direction, the instant writ petition is disposed of finally.
