Heard Shri Neeraj Kant, learned counsel for the petitioner and Shri Rajesh Kumar Yadav, learned counsel for the respondents.
This writ petition has been filed by the petitioner praying for a mandamus to be issued to the respondents to pay his all retiral dues along with interest and further pay the pension of the petitioner on month to month basis. It may also be directed to the respondents to decide his representation dated 23.03.2018 which is pending before respondent no. 2 (Nagar Ayukt, Nagar Nigam, Allahabad).
Learned counsel for the respondents has informed this Court that the Nagar Nigam, Allahabad was facing a financial crisis. Now funds are available and all retiral dues shall be made to the petitioner. He says that this writ petition may be disposed of with a direction to respondent no. 2 to finally decide the petitioner's representation dated 23.03.2018.
Accordingly, the present writ petition is disposed of with a direction to the respondent no. 2 to look into the grievance of the petitioner with regard to non-payment of his retiral dues and take a final decision on the representation dated 23.03.2018 filed by the petitioner by means of a reasoned and speaking order as expeditiously as possible say within a period of six weeks from the date a certified copy of this order is filed before him.
In case some payment is found due to be paid to the petitioner, the same shall be paid by the respondents within a period of eight weeks thereafter.
